Terms of Service

1. Acceptance of Terms

By accessing or using the Kamvo mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App. Kamvo is operated by CamraGo LLC ("we," "us," or "our").

2. Eligibility

You must be at least 18 years old to use Kamvo as either a client or a shooter. By using the App, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into a binding agreement.

3. Description of Service

Kamvo is an on-demand platform that connects clients seeking photography services ("Clients") with independent photographers ("Shooters"). Kamvo facilitates the connection but does not provide photography services directly. Shooters are independent contractors, not employees of CamraGo LLC.

4. Account Registration

To use Kamvo, you must create an account with accurate and complete information. You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account. You must notify us immediately of any unauthorized use.

Shooters must complete identity verification through our third-party provider (Stripe Identity) before accepting jobs. This verification is required to ensure platform safety and compliance.

5. Pricing and Payment

Sessions are billed at $2.00 per minute with a 5-minute minimum ($10.00). Clients are charged upfront for the booked duration. If a session runs longer than the booked time ("overtime"), the Client's payment method will be charged automatically for the additional time at the same rate.

Kamvo charges a 20% platform fee. Shooters receive 80% of the session total. Payments are processed through Stripe. By using Kamvo, you agree to Stripe's terms of service.

6. Cancellation and Refund Policy

Client Cancellations:

• Before a Shooter is matched: Full refund.
• After a Shooter is matched, for valid reasons (Shooter not responding, Shooter exceeded ETA by 5+ minutes): Full refund. The incident is logged for review.
• After a Shooter is matched, "Changed my mind": No refund. Shooter receives compensation.

Shooter Cancellations:

• If a Shooter cancels for any reason, the Client receives a full refund. Shooters must provide an explanation, which is logged for admin review.

Client No-Show:

• If a Client fails to appear within 5 minutes of the Shooter's arrival, the Shooter may mark the booking as a no-show. The Shooter receives compensation and the Client does not receive a refund.

7. Content Ownership and Delivery

All photographs and videos created during a Kamvo session ("Content") are owned exclusively by the Client. The Shooter transfers all rights, title, and interest in the Content to the Client upon session completion.

Content Delivery:

• Content is transferred directly between Shooter and Client via AirDrop (iPhone to iPhone) or through the in-app chat.
• Kamvo does not store, process, or have access to the Content created during sessions.
• Shooters are responsible for delivering all Content before marking a session as complete.

Content Deletion:

• Upon Client request, Shooters must promptly delete all Content from their device.
• Shooters may not retain, backup, or store Content after delivery without explicit written consent from the Client.
• Failure to delete Content upon request is a violation of these Terms and may result in account termination.

Shooters may not use, publish, share, or display any Content from Kamvo sessions for any purpose—including portfolios, social media, or marketing—without prior written consent from the Client.

8. User Conduct

You agree not to:

• Use the App for any unlawful purpose
• Harass, threaten, or abuse other users
• Misrepresent your identity or qualifications
• Interfere with the App's operation
• Circumvent the platform to arrange services directly with users met through Kamvo
• Request or create Content that is illegal, obscene, or violates third-party rights

9. Safety and Incidents

Kamvo monitors user behavior through an incident tracking system. Users who accumulate multiple incidents may have their accounts flagged for review, suspended, or permanently terminated at our discretion. We reserve the right to remove any user from the platform for safety concerns.

10. Independent Contractor Relationship

Shooters are independent contractors. Nothing in these Terms creates an employment, partnership, or agency relationship between Shooters and CamraGo LLC. Shooters are responsible for their own taxes, insurance, equipment, and compliance with applicable laws.

11. Limitation of Liability

Kamvo provides the platform "as is" without warranties of any kind. We are not liable for the quality of photography services, disputes between users, or any damages arising from use of the App. Our total liability shall not exceed the amount you paid to Kamvo in the 12 months preceding any claim.

12. Indemnification

You agree to indemnify and hold harmless CamraGo LLC, its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the App or violation of these Terms.

13. Dispute Resolution

Any disputes arising from these Terms or your use of Kamvo shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You waive any right to participate in a class action lawsuit.

14. Modifications

We may update these Terms at any time. Continued use of the App after changes constitutes acceptance of the updated Terms. Material changes will be communicated via the App or email.

15. Termination

We may suspend or terminate your account at any time for violation of these Terms or for any reason at our sole discretion. You may delete your account at any time through the App settings.

16. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict of law principles.

18. Privacy Policy

Your use of Kamvo is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. By using the App, you consent to our data practices as described in the Privacy Policy.

19. Location Services

Kamvo requires access to your device's location services to function. Clients use location to specify session locations. Shooters share their real-time location during active jobs for safety and coordination. You consent to this location tracking while using the App.

20. Communications

By creating an account, you consent to receive push notifications related to bookings, job offers, and platform updates. You may disable notifications in your device settings, but this may impact your ability to use the service effectively.

21. Device Permissions

Shooters grant Kamvo permission to access their device camera and photo library for the purpose of capturing and delivering Content during sessions.

22. Prohibited Content

Kamvo may not be used to create Content depicting minors without parental consent present, adult or explicit material, illegal activities, or Content that violates any third party's rights.

23. Force Majeure

We are not liable for delays or failures due to circumstances beyond our control, including natural disasters, pandemics, or technical failures.
